Terms of Use

1. Acceptance of Terms

By downloading, installing, or using BeatShort ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms are between you and Pixeliro, the developer and publisher of BeatShort.

Your use of the App is also subject to Apple's Licensed Application End User License Agreement (EULA), which is incorporated herein by reference. In the event of a conflict, Apple's EULA takes precedence.

2. License Grant

Subject to these Terms, Pixeliro grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple device that you own or control, solely for your personal, non-commercial use.

You may not:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Sell, sublicense, rent, or otherwise transfer the App to a third party
  • Remove or obscure any proprietary notices within the App
  • Use the App for any unlawful purpose or in violation of any applicable law

3. Subscriptions & In-App Purchases

3.1 Free Tier

BeatShort is free to download and includes a free tier with limited features. Free tier users may be shown advertisements (see Section 4).

3.2 Pro Subscription

The Pro plan is offered as an auto-renewing subscription at $4.99 USD per month (pricing may vary by region based on the App Store local pricing matrix). Pro unlocks all templates, unlimited AutoShorts, all GPU transitions, 4K export, and removes ads.

3.3 Billing & Auto-Renewal

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
  • Your account is charged for renewal within 24 hours prior to the end of the current period.
  • Subscription prices may change; you will be notified in advance.

3.4 Free Trials

When available, free trials convert to paid subscriptions automatically at the end of the trial period unless cancelled beforehand.

3.5 Managing & Cancelling Subscriptions

You can manage or cancel your subscription at any time via iOS Settings → [Your Name] → Subscriptions. Cancellation takes effect at the end of the current billing period. No refunds are issued for the unused portion of a subscription period, except as required by applicable law.

3.6 Refunds

All refund requests are handled exclusively by Apple. Contact Apple Support at reportaproblem.apple.com for refund inquiries. Pixeliro has no ability to issue refunds directly.

4. Advertising

Free tier users may see rewarded interstitial ads powered by Google AdMob. Ads are served in exchange for unlocking additional exports. By using the free tier, you consent to ad display. You can remove ads by subscribing to Pro. Pixeliro is not responsible for the content of third-party ads.

5. Your Content

You retain all rights to the photos, videos, and audio files you import into the App ("Your Content"). By using the App, you confirm that:

  • You own or have the necessary rights and permissions to use Your Content.
  • Your Content does not infringe any third party's intellectual property, privacy, or publicity rights.
  • Using commercially licensed music (e.g., songs from streaming services) in exported videos may require separate licenses from rights holders.Pixeliro is not responsible for any copyright claims arising from your use of third-party music.

Pixeliro does not access, collect, or claim any rights to Your Content. All processing occurs on-device.

6. AI Features & Third-Party API

AI-enhanced features in BeatShort may use your own OpenAI API key, entered voluntarily in settings. When you use these features:

  • Your API requests are sent directly from your device to OpenAI's servers.
  • You are responsible for compliance with OpenAI's Terms of Service and usage policies.
  • You are responsible for any costs incurred through your OpenAI account.
  • Pixeliro is not affiliated with OpenAI and provides no warranty for OpenAI services.

7. Intellectual Property

BeatShort and all its contents, features, and functionality — including but not limited to beat templates, GPU shaders, UI design, source code, logos, and trademarks — are the exclusive property of Pixeliro and are protected by copyright, trademark, and other intellectual property laws.

The beat templates, AutoShort algorithms, and Metal GPU transitions included in the App are original works created by Pixeliro. You may not extract, copy, or redistribute these assets.

8. Prohibited Uses

You agree not to use the App to:

  • Create, store, or share illegal, defamatory, obscene, or harmful content
  • Infringe any third party's intellectual property rights
  • Distribute malware, spam, or unauthorized automation
  • Attempt to gain unauthorized access to any system or network
  • Violate any applicable law or regulation

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PIXELIRO DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXELIRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF PIXELIRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL PIXELIRO'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Pixeliro, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the App, Your Content, or your violation of these Terms.

12. Termination

Pixeliro may terminate or suspend your access to the App at any time, without notice, for conduct that Pixeliro believes violates these Terms or is harmful to other users, Pixeliro, or third parties. Upon termination, your license to use the App ceases immediately.

13. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will update the "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms. If you do not agree with a material change, your sole remedy is to stop using the App.

14. Governing Law

These Terms are governed by the laws applicable in the jurisdiction wherePixeliro is incorporated. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
